1. Acceptance of Terms

Welcome to Portable Conveniences. By accessing our website, placing an order, or using our portable toilet rental services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Portable Conveniences (“Company,” “we,” “us,” or “our”), a portable toilet rental service provider with headquarters located at 1100 S Hope St, Los Angeles, CA 90015.

2. Service Description

Portable Conveniences provides portable toilet rental services for events, construction sites, and other venues throughout the United States. Our services include delivery, setup, maintenance, and pickup of portable toilet units. Specific services, availability, and pricing may vary by location and are subject to change without prior notice.

3. Rental Agreements and Bookings

3.1 Reservations: All rental reservations must be made through our website, by phone at (877) 441-5083, or through other authorized booking channels. Reservations are subject to availability and confirmation by our team.

3.2 Accuracy of Information: You agree to provide accurate, current, and complete information during the booking process, including delivery address, event dates, contact information, and special requirements. You are responsible for ensuring all information is correct.

3.3 Minimum Rental Periods: Rental periods and minimum rental durations vary by location and service type. Specific terms will be outlined in your rental agreement or quote.

3.4 Confirmation: Your rental is not confirmed until you receive written confirmation from Portable Conveniences via email or other documented communication.

4. Payment Terms

4.1 Pricing: All prices are quoted in U.S. dollars and are subject to change. The price confirmed in your rental agreement will apply to that specific reservation.

4.2 Payment Methods: We accept major credit cards, debit cards, and other payment methods as specified during booking. Payment information must be provided at the time of reservation.

4.3 Payment Schedule: Payment terms will be outlined in your rental agreement. Depending on the service type and rental duration, payment may be required in full at booking or may be split into deposits and final payments.

4.4 Late Payments: Late payments may result in late fees, service suspension, or cancellation. We reserve the right to charge interest on overdue balances at the maximum rate permitted by law.

4.5 Additional Fees: Additional fees may apply for services, including but not limited to: extended rental periods, additional servicing, relocation of units, cleaning fees for excessive waste or misuse, and damage charges.

5. Delivery, Setup, and Pickup

5.1 Delivery Access: You are responsible for ensuring adequate access to the delivery location. This includes sufficient clearance for our delivery vehicles, level ground for unit placement, and removal of any obstacles. If our team cannot access the site safely or legally, additional fees may apply, or service may be refused.

5.2 Placement Instructions: You must provide clear instructions for unit placement. Once units are placed and you or your representative approves the location, relocation fees will apply for any subsequent moves.

5.3 Delivery Windows: We will provide estimated delivery and pickup windows. While we strive to meet these timeframes, they are estimates and not guaranteed. We are not liable for delays caused by weather, traffic, site access issues, or other circumstances beyond our reasonable control.

5.4 Pickup: Units must be ready for pickup at the agreed-upon time. You are responsible for ensuring the units remain accessible for pickup. Delays in pickup caused by the customer may result in additional rental charges.

6. Customer Responsibilities

6.1 Proper Use: You agree to use the rented units only for their intended purpose and in accordance with all applicable laws, regulations, and health codes. Misuse of equipment may result in additional charges and termination of service.

6.2 Prohibited Items: The following items are strictly prohibited from being disposed of in our units: hazardous materials, chemicals, construction debris, food waste (unless contracted explicitly for), feminine hygiene products in non-designated units, diapers (unless contracted explicitly for), and any illegal substances.

6.3 Site Maintenance: You are responsible for maintaining the area around the units, keeping them accessible, and preventing vandalism or damage to the equipment.

6.4 Security: You are responsible for the security of the rented units during the rental period. This includes preventing unauthorized access, vandalism, theft, or damage.

6.5 Compliance: You must comply with all local, state, and federal regulations regarding the placement and use of portable toilets.

7. Servicing and Maintenance

7.1 Regular Servicing: For rentals exceeding one week, regular servicing is typically included and scheduled based on usage and rental terms. Service schedules will be outlined in your rental agreement.

7.2 Emergency Service: If you require additional servicing beyond the scheduled service, please get in touch with us immediately. Additional service calls may incur extra charges.

7.3 Reporting Issues: You must report any damage, malfunction, or concerns with the units promptly by calling (877) 441-5083.

8. Damage and Liability

8.1 Customer Liability: You are liable for any damage to the rented units beyond normal wear and tear during the rental period. This includes, but is not limited to, vandalism, graffiti, theft, fire damage, structural damage, and damage caused by improper use or by prohibited items.

8.2 Damage Charges: In the event of damage, you will be charged the cost of repair or replacement. We will provide documentation and itemized charges for any damage claims.

8.3 Company Property: All rented units remain the property of Portable Conveniences. Any attempt to modify, alter, or permanently relocate units without authorization is prohibited.

9. Cancellation and Refunds

9.1 Cancellation by Customer: Cancellation policies vary based on the type of rental and timing. Generally, cancellations made more than 48 hours before the scheduled delivery date may be eligible for a partial or full refund, less any applicable processing fees. Cancellations made within 48 hours of delivery may not be eligible for refunds.

9.2 Weather-Related Cancellations: We understand that weather can impact outdoor events. Please get in touch with us to discuss options if weather affects your event. Weather-related cancellations are subject to our standard cancellation policy unless otherwise agreed upon.

9.3 Cancellation by Company: We reserve the right to cancel or refuse service at our discretion, including but not limited to: inability to access the delivery site, safety concerns, violation of these Terms, non-payment, or suspected fraudulent activity. In such cases, you will receive a refund of any prepaid amounts.

10. Limitation of Liability

To the maximum extent permitted by law, Portable Conveniences and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to our services shall not exceed the total amount paid by you for the specific rental giving rise to the claim.

We are not responsible for any personal injury, property damage, or other losses arising from the use or misuse of our equipment, except to the extent caused by our gross negligence or willful misconduct.

11. Indemnification

You agree to indemnify, defend, and hold harmless Portable Conveniences, its officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use or misuse of our services, (b) your violation of these Terms, (c) your violation of any third-party rights, including property rights or privacy rights, or (d) any damage to our equipment while in your possession or control.

12. Insurance

We maintain appropriate insurance coverage for our business operations. Customers are encouraged to verify that their insurance policies cover rental equipment and potential liabilities arising from events or construction sites where our units will be placed.

13. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, pandemic, epidemic, or public health emergencies.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes arising from or relating to these Terms or our services shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs of arbitration.

Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

15. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

Material changes to existing rental agreements will be communicated to affected customers by email or other direct means.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with any rental agreement, quote, or invoice provided to you, constitute the entire agreement between you and Portable Conveniences regarding our services and supersede all prior agreements and understandings, whether written or oral.

18. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Assignment

You may not assign or transfer these Terms or your rental agreement without our prior written consent. We may assign or transfer these Terms or any rental agreement at our discretion, including to any successor or affiliate.
